Terms of Service

Agreement to Terms

By accessing or using Hotspot DJ, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Use License

Hotspot DJ grants you a personal, non-exclusive, non-transferable, limited license to:

  • Download and install the Hotspot DJ mobile application on your device(s)
  • Use the application and service for your sports team's game-day music management
  • Create, manage, and play playlists during sporting events

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Hotspot DJ at any time.

Account Requirements

To use Hotspot DJ, you must:

  • Be at least 13 years old (or have parental consent)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

Subscription and Billing

Hotspot DJ offers subscription-based access to our service:

  • Free Trial: New users may receive a free trial period. You may cancel at any time during the trial without being charged.
  • Subscription Plans: After any trial period, you will be charged the subscription fee for your chosen plan.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Payment: You authorize us to charge your payment method on a recurring basis.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of your billing period.
  • Refunds: Refunds are generally not provided for partial subscription periods, except as required by law.

Music Licensing and Usage

You are responsible for ensuring you have the appropriate rights and licenses to play music at your events:

  • Hotspot DJ provides the technology platform but does not grant music licensing rights
  • You must obtain necessary performance licenses (e.g., ASCAP, BMI, SESAC) for public performances
  • Music streaming integrations are subject to the terms of third-party services (Spotify, Apple Music, etc.)
  • You agree to use the service only for authorized and legal music playback

Prohibited Conduct

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Violate any intellectual property rights, including copyright and trademark laws
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the service or servers
  • Share your account credentials with others
  • Use the service to transmit any harmful code, viruses, or malware
  • Reverse engineer, decompile, or disassemble any aspect of the application
  • Remove any copyright or proprietary notices from the application

Intellectual Property

The Hotspot DJ application, service, and all related content, features, and functionality are owned by Hotspot DJ and are protected by international copyright, trademark, and other intellectual property laws. Our logo, product names, and service marks are trademarks of Hotspot DJ.

Service Availability

We strive to provide reliable service but do not guarantee that Hotspot DJ will be available at all times or without interruption. We may modify, suspend, or discontinue any aspect of the service at any time. We are not liable for any service interruptions or unavailability.

Limitation of Liability

To the maximum extent permitted by law, Hotspot DJ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will meet your requirements or be error-free.

Indemnification

You agree to indemnify and hold harmless Hotspot DJ and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the service, violation of these terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any breach of these Terms of Service. Upon termination, your right to use the service will immediately cease. All provisions of these terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hotspot DJ operates, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the new terms and updating the "Last updated" date. Your continued use of the service after changes become effective constitutes acceptance of the revised terms.
